Terms and Conditions
§ 1 Scope of Application
These General Terms and Conditions apply to all contracts between emergency-trainings.de (hereinafter "Provider") and the customer for the conduct of courses, seminars, training and other services in the field of emergency training.
§ 2 Conclusion of Contract
The contract is concluded by the written or electronic registration of the customer and confirmation by the Provider. Registration is binding.
§ 3 Scope of Services
The Provider conducts courses, seminars, training and further services in the field of emergency training, emergency medicine and fire protection. The specific scope of services is determined by the respective service description and contract confirmation.
§ 4 Prices and Payment Terms
4.1 The prices displayed at the time of booking apply.
4.2 All prices are exclusive of statutory value-added tax (VAT).
4.3 Payment is due without deduction within 14 days of invoice.
§ 5 Cancellation and Withdrawal by the Customer
5.1 Cancellation periods and fees:
- Cancellation more than 30 days before event start: free of charge
- Cancellation 29 to 15 days before event start: 15% of course fee
- Cancellation 14 to 6 days before event start: 25% of course fee
- Cancellation less than 5 days before event start: 30% of course fee, minimum €350.00 net
5.2 The receipt of written cancellation at the Provider determines the cancellation period.
5.3 Cancellation must be made in writing (by email, fax or mail).
5.4 The customer may name a substitute participant, provided that this person meets the technical requirements for the booked event.
§ 6 Cancellation and Changes by the Provider
6.1 The Provider reserves the right to cancel or reschedule events due to insufficient participant numbers or other important reasons.
6.2 In the event of cancellation by the Provider, all payments already made will be refunded in full. No further claims exist.
6.3 Changes to dates, location or instructors will be communicated to the customer in a timely manner.
§ 7 Participation Conditions
7.1 The participant is obligated to appear punctually and follow the instructions of the instructors.
7.2 In the event of non-participation without timely cancellation, the full course fee is due.
7.3 The Provider may exclude participants from the event in case of disruptions or non-compliance with safety regulations. In this case, there is no entitlement to a refund of the course fee.
§ 8 Liability
8.1 The Provider's liability is limited to intentional acts and gross negligence.
8.2 In the event of slightly negligent breach of essential contractual obligations, the Provider is liable only for foreseeable, contract-typical damage.
8.3 Liability for personal injury remains unaffected.
8.4 The participant participates in the events at their own risk and will be informed of possible risks.
§ 9 Data Protection
The Provider processes personal data exclusively for contract execution and in accordance with applicable data protection regulations. Further information is contained in the privacy policy.
§ 10 Copyright
All training materials and resources are protected by copyright. Reproduction or distribution without the consent of the Provider is prohibited.
§ 11 Final Provisions
11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2 Place of performance and jurisdiction is the location of the Provider.
11.3 If any provision should be invalid, the validity of the remaining provisions remains unaffected.
11.4 Amendments and supplements require written form.
